Civil Aviation Administration of China (hereinafter referred to as CAAC) shall enforce the supervision and administration over the activity of the nation-wide transport of dangerous goods by air according to its responsibility. The Regional Administration of Civil Aviation of China (hereinafter referred to as CAAC Regional Administration) shall, according to its responsibility, enforce the supervision and administration over the activity of the transport of dangerous goods by air within the region under its jurisdiction. 第四條 Article 4 本規(guī)定中下列用語(yǔ),除具體條款中另有規(guī)定外,含義如下: The following terms as used in this Regulation contain the following meaning except as otherwise provided in specific articles: (一)“危險(xiǎn)品”是指列在《技術(shù)細(xì)則》危險(xiǎn)品清單中或者根據(jù)該細(xì)則歸類(lèi)的能對(duì)健康、安全、財(cái)產(chǎn)或者環(huán)境構(gòu)成危險(xiǎn)的物品或者物質(zhì)。 (1) Dangerous goods. Articles or substances which are capable of posing a risk to health, safety, property or the environment and which are shown in the list of dangerous goods in the Technical Instructions, or which are classified according to these Instructions. (二)《技術(shù)細(xì)則》是指根據(jù)國(guó)際民航組織理事會(huì)制定的程序而定期批準(zhǔn)和公布的《危險(xiǎn)物品安全航空運(yùn)輸技術(shù)細(xì)則》(Doc9284 號(hào)文件)。 (2) Technical Instructions. The Technical Instructions for the Safe Transport of Dangerous Goods by Air (Doc 9284), approved and issued periodically in accordance with the procedure established by the ICAO Council. (三)“經(jīng)營(yíng)人”是指以營(yíng)利為目的使用民用航空器從事旅客、行李、貨物、郵件運(yùn)輸?shù)墓埠娇者\(yùn)輸企業(yè),包括國(guó)內(nèi)經(jīng)營(yíng)人和外國(guó)經(jīng)營(yíng)人。 (3) Operator. The public air transport enterprise engaged in transport of passenger, baggage, cargo and mail by civil aircraft for profits, including domestic operator and foreign operator. (四)“托運(yùn)人”是指為貨物運(yùn)輸與承運(yùn)人訂立合同,并在航空貨運(yùn)單或者貨物記錄上署名的人。 (4) Shipper. The person whose name appears on the Air Waybill or Shipment Record, as the party contracting with carrier for the carriage of cargo. |
